1. Agreement to Terms

By scheduling, purchasing, or receiving services from Detailing by 37th LLC ("Company," "we," "our," or "us"), you ("Customer") agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

2. Services Overview

Detailing by 37th LLC provides professional auto detailing services at 3730 Stevens Ave, Minneapolis, MN 55409, including express wash, interior detail, exterior detail, full detail packages, paint correction, and ceramic coating application.

3. Eligibility and Permitted Use

Our services are available only to individuals who are 18 years of age or older. By using our services, you represent that you meet this age requirement and that you are the owner of, or have authorization to authorize services on, the vehicle presented.

4. Non-Binding Estimates

All price estimates provided prior to inspection are non-binding and subject to change based on vehicle condition, size or type, additional services required, or unforeseen circumstances discovered during the detail. Final pricing will be confirmed before work begins.

5. Appointments, Cancellations, and Rescheduling

We require a minimum of 24 hours' notice to cancel or reschedule without charge. Cancellations with less than 24 hours' notice or no-shows may be subject to a cancellation fee. We reserve the right to reschedule due to weather, equipment issues, or unforeseen circumstances, with prompt notification to you.

6. Membership and Subscription Terms

Plan Options: Silver ($79/mo), Gold ($129/mo), and Platinum ($199/mo) monthly plans, and annual equivalents at a 15% discount.

Billing: Fees are billed monthly or annually on the enrollment date. Auto-renewal occurs automatically unless canceled.

Cancellation: Provide at least 5 business days' notice before your next billing date. Cancellations received after this window take effect the following billing cycle.

Skip Option: Gold and Platinum members may skip one (1) billing month per calendar year with 5 business days' notice.

Price Changes: We will provide at least 30 days' advance notice of any pricing changes. Continued use after the effective date constitutes acceptance.

Auto-Renewal: By enrolling, you authorize recurring charges to your payment method until canceled.

7. Vehicle Condition and Customer Responsibility

Please remove all valuables, personal items, and sensitive documents before drop-off. You represent that you are authorized to approve services on the vehicle. We are not responsible for any items left in the vehicle during service.

8. Pre-Existing Damage Disclaimer

We conduct a vehicle inspection before beginning any service. Pre-existing damage (scratches, dents, chips, rust, stains, mechanical issues, etc.) will be noted prior to work. We are not liable for pre-existing conditions.

9. Satisfaction Guarantee

If you are not satisfied with the result of any service, notify us within 48 hours of service completion and we will re-perform the specific area at no additional charge. This guarantee does not apply to dissatisfaction resulting from pre-existing damage, out-of-scope services, or unreasonable expectations.

10. Limitation of Liability

To the fullest extent permitted by law, Detailing by 37th LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.

11. Personal Property Disclaimer

We are not responsible for damage to, or loss of, personal property left in or on the vehicle, including electronics, cash, jewelry, documents, or accessories. Please remove all valuables prior to drop-off.

12. Intellectual Property

All branding, logos, content, and materials associated with Detailing by 37th LLC are owned by or licensed to the Company and may not be used without prior written consent.

You agree to indemnify and hold harmless Detailing by 37th LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms, misuse of our services, or violation of any applicable law.

We reserve the right to modify these Terms at any time. Updated Terms will be communicated to active customers. Continued use of our services constitutes acceptance of any revised Terms.

17. Termination

We reserve the right to refuse service, cancel memberships, or terminate our relationship with any customer who violates these Terms, provides false information, or engages in abusive conduct toward our staff.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Minnesota. Disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Hennepin County, Minnesota, in accordance with applicable arbitration rules.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Detailing by 37th LLC with respect to your use of our services and supersede all prior agreements.
